The Federal High Court in Abuja on Wednesday sacked the Senator representing Kogi East Senatorial District, Attai Aidoko of the Peoples Democratic Party.
Justice Gabriel Kolawole in his judgment, ordered the Clerk of the National Assembly to have Air Marshal Isaac Alfa (rtd) also of the PDP sworn in to replace Aidoko.
The judge ordered that Alfa, and not Aidoko, was the winner of the PDP’s primary held in Idah on December 7, 2015.
He ruled that Alfa was thus the rightful candidate of the PDP in the March 28, 2018 election conducted by the Independent National Electoral Commission.
PDP had won the election.
The judge, in his judgment, ordered INEC to immediately withdraw the Certificate of Return issued to Aidoko in 2015.
He also ordered the Clerk of the National Assembly to immediately withdraw the recognition and privileged being accorded Aidoko as a senator.
Justice Kolawole condemned the ways and manner in which the PDP discarded the results of its primary election won by Alfa and went ahead to use fictitious documents to back Aidoko’s nomination to INEC.
He added that the nomination of Aidoko by PDP “was an exercise in futility to rob the plaintiff of the fruit of his election in the primary”.
Earlier, Justice Kolawole had dismissed the preliminary objection by Aidoko challenging jurisdiction of the court to entertain the matter.
The court awarded a cost of N750,000 against each of the defendants – Aidoko and the PDP.
