Libel: Amber Heard requests for new trial against Johnny Depp
Amber Heard is seeking to dismiss the winning verdict of Johnny Depp, her ex-husband, in the defamation case against her.
Depp’s suit against the actress went to a trial on April 11 and ended on June 1 with the actor’s victory.
Heard had registered her disappointment with the verdict which she said was “a setback for women”.
In a 43-page memo filed before a Virginia court on Friday, the actress’ lawyers argued that the ruling had poor legal reasoning, an improperly vetted jury, and excessively awarded damages.
Depp had sued Heard for defamation, accusing her of “name-calling” that often escalated into physical violence.
The actor said a 2018 domestic violence piece written by Heard in The Washington Post implied he was abusive.
Heard didn’t name the actor but Depp’s lawyers said her allegations made it difficult for him to land acting roles.
The latest filing by Heard demanded that the court either dismiss the verdict or re-try the case.
Heard further demanded that the court reinvestigate the case and take the necessary action afterward.
“Ms. Heard respectfully requests this court to set aside the jury verdict in favor of Mr. Depp and against Ms. Heard in its entirety, dismiss the complaint, or in the alternative, order a new trial,” a memo by her lawyer read.
“Ms. Heard further requests this court to investigate potential improper juror service and take appropriate action warranted by the results of the investigation.”
